Authorization
On 10 December 2015 National Commission on State Regulation of Energy and Utilities in Ukraine (the “Regulator”) adopted a procedure to determine the local content to obtain bonuses to Green Tariff (the “Procedure”), Resolution № 2932.
The Procedure has been registered by Ministry of Justice of Ukraine on 22 January 2016, published by the Regulator and entered into force only on 26 February 2016.
According to the Procedure, an electricity producer may receive a bonus if submits the following documents:
The Regulator shall consider a submitted package of documents and pass a decision within 30 calendar days from the date of their submission. If the package is not full or provided documents are insufficient to determine the level of used Ukrainian equipment, the Regulator shall inform the applicant in writing within 15 calendar days. The applicant will have 15 days to cure the discovered defects. If defects are cured within 15 calendar days, the Regulator shall pass a decision within 10 days after getting all necessary documents/information. If they are not cured within this term, the Regulator returns the whole packages and refuses to determine the level of the Ukrainian equipment used.
The Regulator will publish and maintain the register of the equipment of Ukrainian origin that it considered during the adoption of the respective decisions.
