RENEWABLES EXPERTS OPPOSED THE DECISION OF THE KIEV DISTRICT ADMINISTRATIVE COURT

On 10 July 2019 leading RE industry associations held a press conference titled

“The Kyiv District Administration Court Judgement could generate a crisis in the Renewable Energy Sector of Ukraine”. The press conference was organised by the Ukrainian Renewable Energy Association in the Ukrinform news agency.

Due to the court’s decision on the suit of Nikopol Ferroalloy Plant on suspension of the NEURC’s resolutions No. 954 and No. 955 from June 7, 2019 (these resolutions set the tariffs for the SE “NEC “Ukrenergo” for electricity transmission and dispatching management services), non-payment to producers of electricity from RES is expected.

The RE indusry associations called on the Kyiv District Administrative Court to overturn its wrongful decision to suspend the NEURC's resolutions in order to avoid possible negative consequences both for the development of RES in Ukraine and for the state as a whole.

Speaking at the press conference, Andriy Konechenkov, the Chairman of the UWEA Board, stressed: “Stopping the development of the sector will create problems for investors who have already invested their money in the development and construction of the wind power plants; for the manufacturers, who will not receive the payment for the products supplied in due time, which, in turn, could lead to the initiation of legal cases; for banks, which will not be able to get the money back for the loans provided in a timely manner, and, in general, will put an irreparable impact to the investment climate in Ukraine and undermine confidence in the country”.
