Late evening January 31, the National Commission for State Energy and Public Utilities Regulation (NERCPU) made a decision to reduce the "green" tariff that has been active in Ukraine since 2009 in accordance with the Law of Ukraine "On Electricity", in particular:
- For facilities generating electricity from other alternative sources of energy commissioned before 31.03.2013 by 10%.
According to the National Commission for State Energy and Public Utilities Regulation the decision is valid for a period of a state of emergency in the energy sector in accordance with the Resolution of the Cabinet of Ministers of Ukraine from January 14, .2015 № 36-r "On the adoption of temporary emergency measures for the electricity market" and the letter of the Ministry of Energy and Coal Industry of Ukraine from 31.01 .2015 № 01 / 13-0216.
Such decision made by the NERCPU violates the current legislation of Ukraine in the field of renewable energy
The Ukrainian Wind Energy Association is strongly opposed to any “green” tariff manipulation. The association has repeatedly expressed its position on the issue through its press releases and letters addressed to the NERCPU, as well as at the scheduled meetings of the regulatory commission.
The adoption of the decision on the "green" tariffs reduction will have the following negative effects:
Currently the share of electricity from renewable energy sources in the Ukrainian energy mix is slightly more 1%, and the reduction of "green" tariffs will not bring significant savings. On the contrary, it will primarily have a negative impact on the companies generating electricity from wind energy, since wind farms operate with the highest efficiency exactly in the autumn and winter period.
The decision made by National Commission for State Energy and Public Utilities Regulation undermines the confidence of the international financial institutions in the Ukrainian regulatory framework sending a destructive signal to the global renewable energy market.
