Authorization
On October 19, 2012 the NERC Decree No. 749 dd.15.06.2012 “On approval of the Procedure for determining the proportion of raw stock, supplies and equipment,works and services of Ukrainian origin, the cost of construction of energy facilities that produce electricity using alternative energy sources” entered into force.
According to the above Decree, the proper proof of the cost of raw stock, purchased assets, including the main equipment, or services are the primary documents (according to the Law of Ukraine “On Accounting”) confirming their purchase (contracts, invoices, statements, invoices etc.). The cost of work shall be determined according to forms of primary accounting documents in construction No. KБ-2c “Contract Work Acceptance Certificate” and No. KБ-3 “Information about the Cost of Contract Work Performed and Expenses” etc. The Ukrainian origin of raw stock and fixed assets shall be confirmed by a certificate of origin issued in accordance with the procedure established by the Cabinet of Ministers of Ukraine. The origin of works or services shall be determined according to the country of registration ofpersons, who sell, perform or provide them.
Earlier in September the Cabinet of Ministers adopted its Decree No. 878 empowering the Ministry of Regional Development and Construction to set criteria to be met by expert organizations determining the share of raw stock, supplies and equipment, works and services of Ukrainian origin in the cost of construction in the renewable energy sector. It also provides that the Chamber of Commerce of Ukraine or regional chambers of commerce will issue certificates of origin confirming the share of raw stock, supplies and equipment, works and services of Ukrainian origin in the cost of construction in the renewable energy sector.
It should be noted that on October 25, 2012 the National Commission for regulation in the energy sector approved the green tariff with the calculation of the share of raw stock, supplies, works and services of Ukrainian origin in the cost of the RES facility for Tuzlivska wind farm in the settlement Tuzla (Berezansky district, Mykolayiv region).
