Verkhovna Rada specified time period to which the definition of “Ukrainian component” is applied

On November 18, 2011 the Parliament of Ukraine passed the Law No 4065-VI “On Amendments to the Article 17-1 of the Law of Ukraine “On Electric Power Engineering” regarding determination of ratio of Ukrainian goods in the value of construction of electric power industry objects.

The Law specifies that obligation as to 15% of the Ukrainian component as of 2012 will apply only to such objects construction of which began after 01.01.2012 and commissioning took place before 01.01.2013. Similarly, requirements about 30% and 50% will apply only to such objects construction of which began after 01.01.2012 and commissioning took place after 01.010.2013 and01.010.2014, respectively. Therefore, based on literal interpretation, objects construction of which began before 01.01.2012 are not subject to obligation as to “Ukrainian component”.

The Law also stipulated that procedure of determination of the “Ukrainian component” shall be approved by the National Commission responsible for state regulation in the sphere of energy industry in Ukraine. The procedure for issue of certificates about origin of goods in order to confirm their Ukrainian origin for the purposes of this Law shall be approved by the Cabinet of Ministers of Ukraine.
